The rise of electric vehicles (EVs) has brought about a unique challenge for drivers and parking operators alike. A recent trend of EV drivers receiving parking fines while charging their vehicles has sparked an interesting debate.

"If the landowner does not want people charging outside store hours, the chargers must be deactivated, or the EV apps must sync with the parking restrictions," Laban rightly points out.
This highlights a critical gap in communication between landowners, parking operators, and EV charging providers. With EV chargers often located in private car parks, the onus is on the driver to navigate a maze of terms and conditions, many of which are not clearly displayed or understood.
The Anomaly in EV Charging
Laban's experience exposes a crucial anomaly in the rollout of EV chargers on private land. Car park rules, traditionally designed for vehicles that park and stay, have not adapted to accommodate the unique needs of EVs, which often stop solely to charge in designated bays.
This anomaly creates a legal gray area, leaving drivers vulnerable to unexpected fines. As one driver, Anthony Stone, questioned, "How many contracts should a driver be expected to enter to charge a vehicle?"
The Need for Clarity and Standardization
The RAC, a motoring group, has identified parking fines for charging as an increasing problem for EV drivers. They emphasize the need for clearer signage, ensuring drivers understand the parking requirements, charging fees, and operational hours immediately.
"Signage needs to be clearer... Equally, charge point operators should add a warning to their devices and apps to make drivers aware," says Simon Williams, Head of Policy at the RAC.
The Ministry of Housing, Communities, and Local Government has acknowledged the issue, stating that private car parks are governed by contract law and that tariffs for using EV chargers must be clearly displayed. They plan to publish a new code to raise standards for private parking later this year.
